Public Fireworks Guidelines

 

 

1. The discharge of fireworks without a permit is prohibited within the Town of Huron.

 

2. The Town Board, pursuant to the authority granted to it by Penal Law §405.00, designates the Town Supervisor as the permit authority for issuance of fireworks permits in the Town of Huron outside of state parks.

 

3. All fireworks displays must be open to the public. Private displays are prohibited by state law.

 

4. At least five days in advance of the date of a proposed display, the sponsor of a fireworks display shall submit an application to the Town Supervisor setting forth:

 

(a) The name of the body sponsoring the display and the names of the persons actually to be in charge of the firing of the display.

 

(b) The date and time of day at which the display is to be held.

 

(c) The exact location planned for the display, and the name and address of the owner.

 

(d) The age, experience and physical characteristics of the persons who are to do the actual discharging of the fireworks, and a copy of their currently effective license to discharge fireworks issued by the New York State Department of Labor.

 

(e) The number and kind of fireworks to be discharged.

 

(f) The manner and place of storage of such fireworks prior to the display.

 

(g) A diagram of the grounds on which the display is to be held showing the point at which the fireworks are to be discharged, the location of all buildings, highways and other lines of communication, the lines behind which the audience will be restrained and the location of all nearby

trees, telegraph or telephone lines or other overhead obstructions.

 

(h) A description of arrangements for emergencies.

 

(i) A certificate of liability insurance in the amount of at least $1,000,000 for the defense and indemnification of the Town of Huron, New York, the sponsor of the fireworks display, and the fireworks operator, for any claims or suits brought by any person on account of damage to persons or property, including wrongful death, occasioned by the use of such fireworks and all other activities carried out in connection with such fireworks display.

 

5. Upon review of the application, the Town Supervisor may also require such other information as he may deem necessary to protect persons or property.

 

6. The fireworks permit shall require that:

 

(a) The actual point at which the fireworks are to be fired shall be at least two hundred feet from the nearest permanent building, public highway or railroad or other means of travel and at least fifty feet from the nearest above ground telephone or telegraph line, tree or other overhead obstruction.

 

(b) The audience at such display shall be restrained behind lines at least one hundred and fifty feet from the point at which the fireworks are discharged and only persons in active charge of the display shall be allowed inside these lines.

 

(c) All fireworks that fire a projectile shall be so set up that the projectile will go into the air as nearby as possible in a vertical direction, unless such fireworks are to be fired from the shore of a lake or other large body of water, when they may be directed in such manner that the falling residue from the deflagration will fall into such lake or body of water.

 

(d) Any fireworks that remain unfired after the display is concluded shall be immediately disposed of in a way safe for the particular type of fireworks remaining.

 

(e) No fireworks display shall be held during any wind storm in which the wind reaches a velocity of more than thirty miles per hour.

 

(f) All the persons in actual charge of firing the fireworks shall be over the age of eighteen years, competent and physically fit for the task.

 

(g) There shall be at least two such operators constantly on duty during the discharge and that at least two sodaacid or other approved type fire extinguishers of at least two and one-half gallons capacity each shall be kept at as widely separated points as possible within the actual area of the display.

 

6. Where the area of the display is included within a fire district, the fire department must be notified prior to the display.

 

7. No fireworks permit shall be transferable.

 

8. The Town Supervisor may only approve the requested permit if each is fully satisfied that the proposed display will not put public health, safety or welfare at risk, and the application or proposed display complies with all of the requirements of these guidelines and state law.

 

9. The Town Supervisor may revoke a fireworks permit and direct the cancellation or stopping of a fireworks display if he receives information that the proposed display may put public health, safety or welfare at risk, meteorological or other conditions present a risk of injury, he determines that the application contains false or erroneous information, or the display does not comply with all of the requirements of these guidelines or state law.
