Take Notice, taht the following is an Ordinance duly adopted by the Town Board of the Town of Huron, New York, on May 13, 1954, and entered in the minutes, to-wit:

No. 1 of the Year 2002

An ordinance to increase the

fine for littering.

 

 

Section 1.    Definitions.

 

The term "person" as used in this ordinance shall include an individual, partnership, firm, society, club, association, corporation, or municipality and the singular number shall include the plural number.

 

The term "rubbish" shall include waste metal, tin cans, ashes, cinders, glass, pottery, and all discarded substances of a solid nature.

 

The term "garbage" shall include waste food, milk or milk products, dead animals, or parts thereof; and all waste or discarded wood, lumber, paper or vegetalbe matter of any kind, or any other matter which shall be inflammable or capable of fermentation or decay.

 

Section II.    Dumps.

 

The use of any lands within the Town of Huron as a dumping ground for the disposal of rubbish or garbage brought thereto from lands of other persons, is hereby prohibited.

 

Section III.    Garbage.

 

No person shall leave or gather, or cause to be left or gathered, upon or under any land in said town, or in or upon any of the waters, streams or ponds therein, any garbage of any kind which shall be or may become dangerous or harmful to human or animal life, or a breeding place for insects or vermin.

 



Section IV.    Penalty.

 

Any person violating any of the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not less than One Hundred ($100) Dollars and not exceeding Five Hundred ($500) Dollars for each offense, or by imprisonment in the County Jail for not exceeding 14 days, or by both such fine or imprisonment; and upon failure to pay any such fine, to be imprisoned in the County Jail until such fine be paid, not to exceed one day for each dollar of the fine paid up to 14 days.

 

 

                                       Section V.    Effective Date.

 

                 This ordinance shall take effect 15 days after its publication.
