Legal Defense of Town Employees Sued

A law to provide for the Legal Defense and Indemnification of Town Employees sued for acts or omissions occurring within the scope of their employment.

 

Be it enacted by the Town Board of the Town of Huron as follows: 

 

 

Body:

Section 1.

 

    The Town of Huron hereby confers the benefits of section 18 of the Public Officers Law of the State of New York upon the employees of the Town of Huron, and agrees to be held liable for the costs under that statute.

 

Section 2.

 

    The Town of Huron shall provide for the legal defense of any officer or employee of the Town of Huron in (a) any civil action or proceeding arising out of any alleged act or omission in which it is alleged that the officer or employee has violated the civil rights of the claimant, petitioner or plaintiff under sections 1981 and 1983 of the United States Civil Rights Act and (b) any criminal action or proceeding.  The Town of Huron shall idemnify and save harmless such officer or employee in the amount of any judgement or settlement of claim obtained against such officer or employee.  However, such legal defense and idemnification shall only be provided where the officer or employee at the time of such alleged act or omission was acting in good faith and within the scope of his public employment, powers or duties.  The provisions of this section shall be in addition to any other statute, local law or enactment providing for legal defense and idemnification in civil actions brought against such officer or employee.

 

Section 3.

 

    This local law shall take effect immediately upon its filing in the office of the Secretary of State.
