Notice of Adoption of Ordinances

A Local Law to provide for the publication of a notice and a brief description of the provisions of an ordinance in lieu of publication of the full text prior to the adoption thereof, and to provide for the repeal of Local Law No. 1 of 1982, which contains similar provisions, if that law is effective.

 

 

Be it enacted by the Town Board of the Town of Huron as follows:

 

 

 

Body:

1.   Notice of Adoption of Ordinances.

 

     Every ordinance and every amendment or supplement to an ordinance herinafter adopted or approved by the Town of Huron Town Board which is or may be required to be published in full in one or more newspapers in order to make such ordinance, amendment or supplement effective need not be so published in full if there is published in such newspaper or newspapers a notice setting forth the title thereof, a brief description of the provisions thereof, and a statement that the full text thereof is on file and may be inspected in the office of the Town Clerk.  However, publication of the full text of the ordinance in such newspaper or newspapers in lieu of publication of the title, brief description of the provisions, and statement that the full text is on file and may be inspected in the office of the Town Clerk, shall also continue to be a publication sufficient to make such ordinance, amendment or supplement effective.

 

2.    Town Law Superceded.

 

     This local law shall supercede in their application to the Town of Huron the provisions of Sections 133, 264 and 265 of the Town Law relating only to the publication of the full text of an ordinance, amendment or supplement to an ordinance adopted or approved by the Town Board.

 

3.    Repeal of Local Law No. 1 of 1982.

 

     Local Law No. 1 of 1982 of the Town of Huron, which contains similar provisions similar to this law, is hereby repealed.  If Local Law No. 1 of 1982 was never effective, either because it was not filed with the Secretary of State, or for any other reason, this Section 3 shall also not be effective.

 

4.    Separability.

 

    If any section or provision of this local law is for any reason adjudged to be unconstitutional or invalid, such adjudication shall not affect the remainder of this local law, which shall remain valid and effective.

 

5.    Effective Date.

 

     This local law shall be subject to referendum on petition, pursuant to Municipal Home Rule Law Section 24, and shall take effect immediately upon filing in the office of the Secretary of State, pursuant to Municipal Home Rule Law Section 27.
