TOWN OF HURON
Local Law No. 6
of the Year 2005
A Local Law to supercede state law to eliminate the requirement that meetings of the Town Board be held within the Town, and authorizes Town meetings and hearings to be held within the North Rose-Wolcott Central School District.
Be it enacted by the Town Board of the Town of Huron as follows:
1. This law is enacted pursuant to the power of supersession granted to the Town of Huron by Municipal Home Rule Law '10.
2. This law supercedes New York State Town Law '62(2), to the extent it requires that meetings of the Town Board of the Town of Huron be held within the Town of Huron, and authorizes meetings of the Town of Huron Town Board, or any other meetings or hearings held or sponsored by boards or officials of the Town of Huron (including the Zoning Board of Appeals and the Planning Board), to be held at any location within the North Rose-Wolcott Central School District (including a school building) if attendance at such a meeting is anticipated to possibly exceed the legal maximum attendance at the Town Hall.
3. Within the Town of Huron, New York State Town Law '62(2) shall read as follows:
The town board of every town of the first class shall hold at least one meeting in each month. The supervisor of any town may, and upon written request of two members of the board shall within ten days, call a special meeting of the town board by giving at least two days notice in writing to members of the board of the time when and the place where the meeting is to be held. All meetings of the town board shall be held within the town at such place as the town board shall determine by resolution, except that where provision is made by law for joint meetings of two or more town boards such joint meetings may be held in any of the towns to be represented thereat. Notwithstanding the above, if the Town of Huron Town Board anticipates that attendance at a meeting of the Town of Huron Town Board, or any other meeting or hearing held or sponsored by a board or official of the Town of Huron (including the Zoning Board of Appeals and the Planning Board), may exceed the legal maximum attendance allowed at the Huron Town Hall, such a meeting or hearing may be held at another location within the North Rose-Wolcott Central School District, including a school building.
4. If any provision of this law is determined to be unconstitutional or invalid, the validity and enforceability of the remainder shall not be affected.
5. This local law shall take effect upon filing with the Secretary of State.
