Coastal Erosion Hazard Area Law

The amendments to the Coastal Erosion Hazard Area Law were adopted by the Huron Town Board during its regular session 20 October 2008, with one modification.  We are please to announce that the law is now in effect; amendments have been approved by the Department of Environmental Conservation and the amended law has been filed by New York State.

A Local Law to

Amend the Town of Huron

 Coastal Erosion Hazard Area Law

with regard to Regulated Activities

 

Be it enacted by the Town Board of the Town of Huron as follows:

 

1.  Local Law No. 1 of 2002 of the Town of Huron, the Town of Huron Coastal Erosion Hazard Area Law, is amended as follows:

a.  Section 1.6 is amended to change the definition of "REGULATED ACTIVITY" to read as follows:

REGULATED ACTIVITY - The construction, modification, restoration or placement of a structure or addition to a structure or any action or use of land which materially alters the condition of land, including grading, excavating, dumping, mining, dredging, filling or other disturbance of soil.  The term "development" and "activity" when used in this law, have the same meaning as "regulated activity".

 

b.  Paragraph D of Section 2.6 is amended to read as follows:

D.  All development is prohibited on beaches unless specifically provided for by this law, except that a coastal erosion management permit may be granted for a non-major addition to an exisiting structure.

2.  If any provision of this law is determined to be unconstitutional or invalid, the validity and enforceability of the remainder shall not be affected.

 

3.  This Law shall only be effective if it is certified by the Commissioner of the New York
State Environmental Conservation as conforming to the minimum standards of a local coastal erosion management program.

 

4.  This local law shall take effect upon filing with the Secretary of State and the Commissioner of the New York State Department of Environmental Conservation.
